The Feeding or Watering Of Deer is Illegal! On 01-25-2011 the Town of Elizabeth Board of Trustees voted unanimously to enact an Emergency Town Ordinance prohibiting the feeding or watering of deer or other big game animals in the Town of Elizabeth (Town of Elizabeth Municipal Code Section 7-7-700). This ordinance is effective immediately. The feeding of deer or other big game has always been prohibited by Colorado Division of Wildlife regulations. This new ordinance gives the Elizabeth Police Department the ability to prosecute violators in municipal court. The Board of Trustees also passed a resolution establishing the fine for a violation of this new ordinance. The fine for a first offense is $150.00. The fine increases by $100.00 for each subsequent violation. Please be aware that individuals engaged in feeding or providing water to deer are creating a significant public safety issue. There are increased traffic accidents in the area related to the deer, the deer will eventually attract predatory animals to the Town, local landscaping is being decimated, and there is significant damage being caused to property like fences. Feeding of deer is also very unhealthy for the deer and is terrible for wildlife management programs. Please be advised the Police Department will exercise very little discretion in enforcing this ordinance. If you are engaged in feeding deer or providing water to the deer you need to stop. Bird feeders that are knowingly accessible to the deer, and are refilled regularly will be considered to be feeding the deer. Language in the ordinance includes: Sec. 7-7-700. Feeding of Deer and other Big Game Animals. (a) Except as otherwise permitted by law, it shall be unlawful for any person to intentionally place, deposit, distribute or scatter grain, hay, minerals or salt, or other foods, or to provide water for the consumption by deer or other Big Game Animals not lawfully held in captivity. For purposes of this section, “Big Game Animals” means any member of the deer, elk, moose, or antelope families.
